Vistabeam™ Terms of Service

This document describes the policies governing your account with Vistabeam™. Most of the policies are standard Internet policy or are laws governing the Internet in this country and others (the Internet is a global resource). These policies boil down to: play nice and be considerate. Vistabeam™ reserves the right to disconnect or terminate accounts, without notice, that violate these policies.

Bandwidth and Disk Usage
Each Vistabeam™ high speed Internet access account has a standard quota for disk space and data transfer bandwith usage. Additional quota may be added to your account for a recurring fee. Usage above your quota limits will result in additonal charges as described in the Vistabeam™ pricelist.

Connecting
Your Vistabeam™ high speed Internet access account may only be used by you; sharing of accounts violates this policy. Additional accounts are for individuals in the same household or office only and share facilities. That is, only one Vistabeam™ high speed Internet access account - either the master account or any one of the sub-accounts - can be logged into our service at a time. Vistabeam™ monitors account usage and will disallow multiple logons from the same accounts. For dialup customers, unlimited time online means use the connection for as long as you are working, but log off when you are finished. Using automated means to maintain a connection while not actively using the connection is a violation of this policy.

Passwords
In order to ensure the integrity of our system, your password must be secure. Your password is your means of protecting the integrity and content of your account and Vistabeam™ high speed Internet access service. Allowing someone else access to your password compromises the security of your Vistabeam™ high speed Internet access account, Vistabeam™ system access, and violates this policy. The quickest way for your account to be terminated is to compromise the security of your Vistabeam™ high speed Internet access service. You should use a random sequence of characters and numbers for your passsword, including both upper and lower case. Specifically, you should not use a password that is a single word from a dictionary or everyday usage; anything personal that is easily guessed (license plate number, birth date, significant other's name, social security number, etc.); any of the above with a single leading or trailing number. In addition, you should change your password on a regular basis; about once per month is appropriate.

Websites
Websites whose contents must be restricted to certain elements of the general population such as adult materials shall be hosted under a unique domain name other than Vistabeam™'s domain names. Publishing copyrighted materials belonging to another without permission is illegal under federal and international copyright law.

Electronic Mail
Vistabeam™ considers your electronic mail confidential; however, routine maintenance on the mail server may result in the contents being viewed by our system administrators. Vistabeam™ can not assure the confidentiality of electronic mail that is routed to or from other providers.

Unsolicited spamming - sending the same or similar mail many times to one or more destinations - is strictly prohibited, as is using your account as a drop-box for spam.

Forging your identity with the intent to misrepresent or mask your legal identity will result in immediate account termination.

Usenet News
Some electronic mail policies apply to Usenet newsgroups - no spamming (including excessive cross-posting) or forging your identity. To make sure you are posting an appropriate article, you should always read the group's charter and the group itself to understand its dynamics.

Software Usage
Vistabeam™ may permit the execution of cgi scripts and software from within a user's directory provided that the cgi scripts/software do not interfere with the files of other users or with system files, do not duplicate functionality already provided by Vistabeam™ (perl, apache, and so on), are not Daemon (permanently-running)processes, and that do not make excessive demands on system resources (number of processes, memory, processor time, network activity, etc.). Vistabeam™ may review scripts or software running from a user's directory and, at its sole discretion and without prior notice, remove software that violates this policy from the System. Upon request, Vistabeam™ may install software for users on the Vistabeam™ system. A fee may be charged for any installation and associated maintenance. Send email to support@vistabeam.com describing any CGI scripts that you install; note that Vistabeam™ does not provide support for software you install.

Illegal Activities
Transmission of any illegal material or use of your account for any illegal activity will result in immediate account termination and/or legal prosecution. Using your account to distribute copyrighted materials without permission is illegal under federal and international copyright law.

Refund Policy
Credit card refunds will be issued 10-15 days from the time of service discontinuation. All Cash & Check refunds will be issued via check 30 days from the time of service discontinuation. All refund checks will be mailed to the address listed on the account at the time of discontinuation. If the customer is moving out of the area, please ensure our office has the proper forwarding address at the time the service is discontinued.

Any customer may discontinue service at any time for any reason. If a customer chooses to cancel services, they must notify Vistabeam™. We will provide them a prorated refund of any unused service fee based on normal monthly rates. Refunds will be based on 1/2 month increments. If service is used only during the first half of the month, 1/2 month refund will be given. If service is used into the second half of the month, no monthly refund will be given.
